Recent Amendments to Rules Governing the
Families First Coronavirus Relief Act
Summary of Presentation:
On August 3, 2020, the federal district court of New York invalidated several of the regulations adopted by the Department of Labor to implement the Families First Coronavirus Response Act. The Court’s decision was unclear on its scope—whether it applied just in New York or nationally. But the Department of Labor responded to the decision on September 16, 2020 issuing amended regulations. This presentation will walk through the problems identified by the New York federal district court, the Department of Labor’s amended regulations, and what these changes may mean for your policies related to Covid-19 sick and FMLA leave.
